On November 19, 2014, a client of Goodman Acker P.C. was driving eastbound on W. Utica
Road at Ryan when another driver turned left off of Ryan (see map below
for location of collision), striking our client in the front driver's
side. The Shelby Township Police Department then investigated the scene
and filed an accident report. Our client was transported to Troy Beaumont
Hospital where she was treated for injuries to her neck, back, right wrist,
right ankle, and both knees.
Goodman Acker P.C. has filed a first and third party lawsuit on behalf
of our auto accident client in Macomb County Circuit Court. The third
party lawsuit will help our client collect compensation for her
pain and suffering damages. This claim is filed against the at-fault driver.
first party lawsuit is filed against our client's own automobile insurance company, AllState,
for her no-fault benefits. No-fault benefits are benefits that help a
victim compensate for economic losses due to the accident. Our Shelby
Township auto accident attorneys are seeking wage loss benefits (income
lost due to time off of work), medical expenses, and transportation costs
to and from medical appointments. AllState has currently denied payment
of benefits, we are seeking to get payment for past and future expenses.
No court date has been set and the case is currently in pre-litigation.
Left-hand turn collisions are almost always the fault of the driver who
is making the left-hand turn. However, if the car going straight through
the intersection runs a red light, this may shift some or all of the liability
away from the car turning left. Every circumstance is different and unfortunately
the reality is that car accidents can happen to anyone. Drivers should
be cautious when driving through intersections, especially very
dangerous ones. Always make sure to do the following when driving through an intersection
to help avoid left hand turn accidents:
- Buckle your seatbelt
- Adjust your mirrors and seat, if needed
- Lower your level of distraction: turn down the radio volume, do not engage
in excessive conversation with passengers, and do not tinker with the
dashboard too often
- Keep your distance from distracted and/or dangerous drivers
- Proceed cautiously while turning or changing lanes.
