Underinsured Motorist Insurance Claims

This coverage protects you in case you are injured by an underinsured driver. This is a driver whose liability insurance is inadequate to satisfy your total claim arising out of an accident. In Michigan, there are many accidents in which the party at fault is underinsured in comparison to the injuries inflicted on the innocent victim. Again, you should take matter into your own hands and protect yourself by purchasing UIM coverage in the largest limits available. UIM coverage is cheap just like UM coverage and when purchased with UM coverage, in the same limits, they will together provide you with umbrella protection for injuries which you may suffer due to someone else's negligence while operating a motor vehicle. Again, UIM coverage can generally be purchased in amounts up to the limits of your liability coverage. You should, once again, purchase at least $100,000/$300,000 limits. If you are injured by an underinsured driver, this too may provide critical protection to you and assist you in putting the pieces of your life back together. The difference in price for larger UIM limits is usually quite small. The additional protection is well worth the price.

In an underinsured motorist situation, where you have UIM coverage in place, once you recover the limits of available insurance from the offending driver, your own insurance company through which you purchased UIM coverage from, will stand in the shoes of the offending driver, up to the available limits of insurance coverage you purchased. As with UM coverage, you UIM coverage requires that you follow certain procedural requirements. We strongly advise you consult with an attorney and make sure not to sign a release for the offending driver without a written consent of you UM/UIM carrier. If you do so, your UM/UIM coverage will be barred. Further, as with UM claims, there is also a limited amount of time in which to bring a UIM claim which varies from policy to policy, carrier to carrier. Act now and do not delay.
