Dramshop Claims

Dramshop suits are statutory claims for personal injury and/or for damage to property caused by the unlawful furnishing of alcohol by an individual or entity with a liquor license. Usually this cause of action involves the liquor licensee serving a minor or visibly intoxicated person, who goes on to injure an innocent third party. There are numerous statutory requirements that must be complied with in any dramshop claim, such as a name and retain provision, mandating that the imbibing minor or the AIP be named and retained as a party defendant through its conclusion in any action against the retail licensee, as well as statutory notice requirements, to give written notice to all potential defendants of the possibility of the claim within 120 days after entering the into the attorney-client relationship, the failure to do which may result in dismissal of any subsequent action. Because of these formal requirements it is imperative that you immediately retain skilled legal counsel such as Goodman Acker, PC to represent and protect your legal interests.
