Detroit Bicyclist Falls into Unmarked Trench

A Wayne County jury awarded $134,000 to our client who was injured while riding her bike due to negligence by a construction contractor. The defense originally offered $90,000 to our client for her injuries. Our bicycle accident attorneys rejected the offer and fought tirelessly in court for the money our client deserved.

On October 17, 2015, at approximately 9:00AM our client was travelling westbound on West Adams Avenue in Detroit, Michigan. She was part of a group ride called Beat the Train. While riding her bike her front tire became lodged in an unmarked trench that was one inch wide but 14 inches deep. She was thrown from her bicycle and suffered serious injuries, including jaw fractures, hearing loss, multiple contusions, and emotional distress.

The trench that caused our client to be thrown from her bicycle was dug by Underground Contractors, Inc. It was dug as part of the installation of internet cable. At the time of our client’s accident, they had not put up signs or warnings in order to ensure the safety of pedestrians or bicyclists. We assisted our client in filing a personal injury lawsuit against the negligent company in the Wayne County Circuit Court. Counsel for Underground Contractors, Inc. continuously argued that the company did everything it could to protect the public from its open excavations and unmarked trenches.

Given the extent of our client’s emotional and physical injuries, our attorneys rejected the offer and opted to pursue litigation in order to recover a larger, more fitting amount of compensation. Our attorneys were able to demonstrate to a jury that Defendant Underground Contractors, Inc. did nothing to protect bicyclists and should be held accountable. A jury ultimately ordered the defendant to pay $134,000 to our client.
