Detroit Personal Injury Lawyers Fighting For The Injured

Madison Heights Car Accident Lawsuit Filed For Failure to Yield in Intersection

On August 9, 2015, our Goodman Acker, P.C. client was involved in a T-bone collision at the intersection of John R. Road and Brockton Road in Madison Heights, Michigan. The car accident took place at approximately 5:09 p.m.

Our client was driving northbound on John R. Road at Brockton when another motorist driving southbound on John R. turned into her vehicle. The impact of the collision caused our client’s vehicle to roll over.

The car accident was investigated by the Madison Heights Police Department. The driver that turned into our client’s vehicle was attempting to turn eastbound onto Brockton Road. However, the driver failed to yield to oncoming traffic and struck our client’s car.

As a result of the crash, our client injured her back, ribs, and shoulder. Her injuries are permanent and progressive. She had no injuries prior to the accident.

Our Detroit car accident lawyers have filed a first and third party lawsuit on behalf of our client in Oakland County Circuit Court. The first party (PIP) lawsuit seeks compensation from our client’s own auto insurance company, AAA, for her no-fault benefits. No-fault benefits sought include payment for her economic damages, such as payment of medical bills and expenses, household services, and more.

The third party lawsuit seeks compensation for her pain and suffering damages against the at-fault driver whose actions were a direct cause of our client’s injuries. Some of the arguments our car accident attorneys will use to show the direct cause include, but are not limited to:

  • The other driver was in violation of his duty to not turn his vehicle from a straight line without first seeing that such movement could be made in safety;
  • The other driver was in violation of his duty to use the proper lanes in traveling on said highways;
  • The other driver was in violation of his duty to operate a vehicle with clear vision.

Since the driver of the accident is underinsured and our client had underinsurance on her own auto insurance policy, we will also be seeking payment for her pain and suffering damages from AAA as well.
