We are currently handling a birth injury case involving the delivery of a baby via C-Section that was performed at William Beaumont Grosse Pointe by a physician and an assistant. The delivering physician or the assistant used inappropriate force and technique for the procedure when they removed the baby by the leg. As a result of their error, the baby suffered a fracture of the femur, the largest bone in the human body.

The break was so bad that the infant was immediately taken to the NICU at St. John Hospital on Moross in Detroit and was later transferred to Children's Hospital of Michigan for surgery. Ultimately, the child did not have surgery and her bone “healed.” But now, the child has one leg that is shorter than the other and is forced to walk with a limp.

Although Beaumont Hospital has acknowledged that the leg was broken during delivery, and that it should not have happened, representatives from the hospital have suggested that Beaumont is not legally responsible for any of the physicians who participated in the labor and delivery.

Additionally, Beaumont Hospital advised that, although they caused it, our client’s injury would not have a significant impact on her quality of life. We were advised by a representative of the hospital that she was BORN with one leg that is shorter than the other, and because of that, our client shouldn’t have any problems living with the same issue caused by the broken leg!

Attorney Tim Sulolli was recently interviewed by Fox 2 Detroit News about the lawsuit, and he had the following to say:

“Her right leg is currently shorter than her left leg, there is a discrepancy, she walks with a limp, and has balance issues. As she grows that leg discrepancy is going to become larger. Unfortunately the hospital has acknowledged this should not have occurred. They are still failing to accept responsibility for what happened.”
