On April 28, 2016, a Detroit woman was driving at the intersection of the Moross/Eastbound turnaround. She was hit by another driver while attempting to cross Moross, despite having the right of way and a green light to do so. The other driver (who was travelling westbound on Moross) failed to stop at a red light, resulting in a direct collision between the two vehicles.
The woman sustained multiple serious injuries to the head, neck, spinal discs, bilateral shoulders, and hips, and the driver who hit her was uninsured at the time of the accident. The injured woman held uninsured motorist coverage from Allstate, which theoretically ought to have guaranteed payment for her injuries and accident-related costs. However, the company refused to supply the necessary compensation.
We at Goodman Acker, P.C. were able to help her file a first-party claim and an uninsured motorist claim against Allstate in the Wayne County Circuit Court. By filing a first-party claim, we were able to assist her in collecting no-fault benefits, which allowed her to cover her existing medical costs at that time. We also engaged in settlement facilitation on her behalf and had her claim evaluated for a total of $80,000.
Allstate declined to settle for the proposed amount. Our client’s claim was then brought to trial, at which point a jury deemed payment of $80,000 to be appropriate, given the injuries and damages inflicted and the terms of the woman’s auto insurance policy. Allstate was required to supply the amount suggested during settlement, as well as compensation for our client’s attorney fees.
