Farmers Insurance Denied PIP Benefits for Man Harmed in Single-Vehicle Car Crash

In December 2015, a Flint-area man fell asleep at the wheel, causing him to veer off the road, strike a cable barrier and crash through a fence. The accident occurred on US-23 SB, approximately ½ mile north of M-59 in Hartland Township.

Under Michigan’s no-fault insurance laws, auto insurance providers are required to compensate policy holders for expenses related to serious injuries, regardless of whether or not the insured party contributed to the accident in question. Our client was insured through Farmers Insurance.

Our client had a history of pre-existing back injuries, which required him to use a walker. The injuries from the car accident aggravated our client’s pre-existing conditions causing him to fall and fracture his left ankle. The fracture left him wheelchair bound, and he required 24/7 attendant care.

Goodman Acker, P.C. represented our client for his first-party or PIP benefits. Medical professionals’ assessed our client’s combined current and future costs associated with his accident and injuries at $250,000. Famers Insurance refused to pay any PIP benefits, claiming his injuries were due to his pre-existing conditions.

Our team at Goodman Acker, P.C. took the case to trial in the Genesee County Circuit Court. The jury ruled in favor of our client awarding him $442,000. We were not able to only obtain our client’s no-fault benefits, we were able to help him obtain almost double than what the case originally evaluated for.
