Sexual Assault Lawsuit Filed Against Whaley Children’s Center in Flint

Goodman Acker P.C. has filed a lawsuit against Whaley Children’s Center and an employee of the facility on behalf of our client who was sexually assaulted on their grounds. Whaley Children’s Center is a Flint state-licensed home for abused, neglected, and at-risk children.

On July 6th, 2015, our client, a 7-year old resident at the facility, was sexually assaulted by a 15-year-old resident while on a playscape on the centers playground. It is believed another 9-year-old resident assisted in the sexual assault.

An employee of the center was to be monitoring the children at the time of the incident. Instead of properly supervising them, the employee sat on a picnic bench approximately 50 yards away from the children, with a partially obstructed view.

The employee not only failed to provide adequate supervision, but also completely ignored the sexual safety plans in place for the two older children who orchestrated the sexual assault.

As a result of the incident our client has suffered severe emotional trauma. In addition, our client, who had no history of sexually acting out before the assault occurred, has since been involved in multiple incidents of inappropriate behaviors. All of this behavior is a result of the sexual assault.

The lawsuit filed on behalf of the parents and child seeks damages related to treatment center bills and emotional trauma.
